(openPR) Protection of human rights…
These words sound promising and suggest the sense of a safety, don’t they? Just think about the moment you start being interested in the question of the protection your rights. Very often you remind it, when something is going to happen against your will, and this situation brakes both your plans and the usual way of the life. As a rule in such moments people either feel scared, or look for the benefit, or they are pushed by an emergency. You also remember about your rights, when the situation ‘on the edge’ appeared. You start running somewhere, asking and begging for a help. And here the most interesting question may be raised — where are you running and whom are you applying for help to?
I have devoted 30 years of my life to legal defense.
During this period, my life gave me an opportunity to get convinced more than once that most people do not think about and even do not have any idea who are the real legal defenders. However, it was always this way. There was such situation during my work at the House of Lords, at the European Court of Human Rights and at the United Nations Human Rights Council.
In most cases, instead of looking for the legal defender, you look for the mechanism of lobbying your interests.
There is a trap here: in such a way, people are fixed into different schemes, having nothing in common with the protection of human rights. Just in this way, people are prepared to be exploited in somebody’s mencenary motives, and then they are in use and threw away as a useless detail of somebody’s working scheme.
I am 65 years old. I live in Genève.
I have achieved much in my life, set up my own business and provided my children, grandchildren and myself with fortune for a long time ago. I do not know, how they will use all this fortune, but it depends on them. I do not know for how long I will live — I am not young, and there are some alarm signals about the condition of my health. I know exactly only one thing: I would not like my grandchildren to be a part of an ignorant mass of those who today name themselves ‘the society’. I consult the respected bankers and officials very often, but they are not my clients now. They are my friends. I emphasize that money hasn’t already interested me for a long time.
I’ve decided to leave a great knowledge… Honestly, I have thought it over for a long time in my head.
Though it would be true to name it a chance. It is chance for other people. It’s a certain series of articles or possibly I’ll have enough health to write several books. I’ll talk about those things with my readers, and it’s impossible to find it in Harvard, Oxford, Genève University or Sorbonne. Nowhere. That’s exactly what at one time allowed me to achieve the results in most situations, when I was a consultant and a human rights defender. I’ve managed to save many people.
Let’s start from the beginning. What is the protection of the human rights and what is the source of the concept?
People think that they have their rights. However, if we approach to this question philosophically, the analogy of the right is a desire for the average person. Perhaps, somebody will ask: “What is the source of the right, then?” The right is nothing like the realization of the desires, permitted by a society. In this way, appears the right as a retransformation of a person’s desire.
His desire turns to the right, determined by the majority of people: what desires are correct and which of them may be realized. For example, the desire to break another person’s car most of the people think wrong. Accordingly, it is forbidden to commit this manner, because no one gives a person such a right. Unwillingly, I remind some words of a famous Russian author Fyodor Dostoevsky: “Whether I am a trembling creature or whether I have the right”. These words are about if it’s possible for a person to establish the rights without a majority. The majority opinion is indifferent for an every person who is capable to do this. Human sets the right independently to allow turning the wishes into the words and the deeds, and than makes these deeds and doesn’t coordinate the actions with the majority.
For some reason at a time appear a people which defend the human rights and named the lawyers and the human rights defenders. It is not excluded, that such activity could be somebody’s hobby. At first sight, probably it will be convenient for human to defend their rights themselves.
You can see, in all countries of the world there are the professional human rights defenders (lawyers), people, which deal with the human rights defense on a social basis, and people which deal with human rights defense as a hobby. Moreover, there is the fourth type of people who are engaged in the protection of the rights in their own interests. However, at first time it seems, this person protects own rights. But he doesn’t want somebody reveal it, and protects the other person doing noble cause to use this precedent for his own benefit. I’ve seen this many times! Unfortunately, most of my colleagues acted the same way.
I think it would be useful to return to the history a few centuries ago, when the institute of the human rights defenders was appeared. This institute takes the beginning from the times of the Crusaders. In the next article, we will talk about this in detail.
